Copyright Agent A/S, acting in partnership with APIX Syndication, a business registered under the laws of Australia, and three US photographers, is pleased to announce the successful conclusion of its dispute with Associated Newspapers Limited, the publishers of the Daily Mail.
The photographers involved are world class photographers, who took seven photographs of four internationally renowned models. The three photographers appointed APIX to manage the licensing of these photographs and APIX then appointed Copyright Agent to enforce the copyrights in those photographs against infringers.
In 2023, Copyright Agent, using sophisticated image tracking software, identified that Associated Newspapers had reproduced the seven photographs in the online version of the well-known English newspaper, The Daily Mail, without the consent or authorisation of the copyright owners or APIX.
Copyright Agent then corresponded with Associated Newspapers and ultimately engaged UK solicitors, Sonder & Clay to act on its behalf in relation to the enforcement of the copyrights.
In June of this year, Associated Newspapers settled Copyright Agent's claim by the payment of £23,500, which included a significant sum in respect of additional statutory damages due to the flagrancy of the infringement and the benefit that had accrued to Associated Newspapers as a result of the infringements.
Copyright Agent’s Legal Advisor, Lara Amen (Cand.jur. LL.M.), who handled the case on behalf of APIX stated: "This case is typical of the multinational nature of our work. The three photographers are all US citizens. The syndication agency is based in Australia. Copyright Agent is headquartered in Denmark and the infringements took place in the UK. This case showcases our international reach and highlights our determination, on behalf of our Partners, to protect their revenue stream, including by the commencement of High Court litigation, where necessary."
